Lyft accident claims and lawsuits: how they work
A Lyft accident claim usually turns on two facts: what the driver’s app status was and who caused the crash. Those facts decide which insurance responds first and whether a lawsuit would be filed against the driver, another motorist or, in some cases, Lyft itself.

Who can make a claim
Lyft passengers, occupants of other vehicles, pedestrians, cyclists and the Lyft driver may each have a claim, but against different coverage. A passenger hurt by another motorist may start with that motorist’s insurer. Someone hit by a Lyft driver starts with the coverage tied to the driver’s app status at the time.
How rideshare coverage applies
State laws require higher limits once a driver accepts a ride. Florida’s statute, for example, requires $1 million in liability coverage during a prearranged ride and lower limits while the driver is only logged on. Lyft’s own policy terms and the state’s requirements together determine what is available.
Florida Statutes §627.748: Transportation network company insurance ↗Claim or lawsuit
Most injury claims begin as insurance claims. A lawsuit may follow when liability is disputed, the offer does not reflect documented losses or a deadline is approaching. Suits are usually filed against the at-fault driver; naming Lyft depends on the facts, the theory of liability and any arbitration terms in the rider agreement.
Evidence to keep
Save the ride receipt, driver profile, route map and any in-app messages or safety reports. Keep the police report number, photos, witness contacts and medical records. Ask your attorney whether a preservation request to Lyft for trip and telematics data is appropriate.
Autonomous rides on Lyft
Lyft riders in some markets can be matched with autonomous vehicles, including Waymo in Nashville since September 2026 and May Mobility in Atlanta. Evidence and responsibility questions for those rides are covered in our self-driving car accident guides.

Frequently asked questions
Can you sue Lyft after an accident?
Most claims start against the at-fault driver’s coverage. Whether Lyft itself can be named depends on the facts, the legal theory and any arbitration terms in the rider agreement.
Does Lyft insurance cover passengers?
During a ride, state law generally requires high liability limits, such as $1 million in Florida, for injuries the Lyft driver causes. Other coverage may apply if another motorist caused the crash.
How long does a Lyft accident claim take?
It depends on medical treatment, whether fault is disputed and how many policies are involved. Ask your attorney which stage the claim is in.
