When insurance limits may not cover car accident losses

An insurance limit describes a coverage ceiling under a policy. It does not measure all the harm from a crash or guarantee a payment. Start by identifying the relevant coverage, the people making claims and the policy terms that apply.

Identify the coverage before comparing numbers

Bodily-injury liability, property-damage liability, collision, medical payments and uninsured/underinsured motorist coverages address different questions. A declaration page summarizes the policy’s coverages, limits and deductibles, while the policy and endorsements provide the terms. Ask which coverage is being discussed and whether a limit is per person, per accident or otherwise defined.

Clarify what is known about the other policy

Ask your attorney which insurer and insured have been identified, whether coverage has been confirmed, and what information about applicable limits is available. Keep uncertainty explicit. A driver’s statement that they carry minimum insurance is not a substitute for reviewing the coverage information through the appropriate claim process.

Review your own possible coverage

Ask your insurer or attorney whether uninsured/underinsured motorist, medical payments, PIP, collision or another coverage should be reviewed for your circumstances. Availability, conditions and reporting requirements depend on the policy and state. The California regulator’s guide explains coverage categories for California consumers; its state-specific rules should not be assumed to govern a crash elsewhere.

Ask about multiple claims and a proposed release

Useful consultation questions include: Are other people claiming against the same coverage? Are other potentially applicable policies being investigated? What claims would a proposed release resolve? What costs or obligations would remain afterward? Ask for an explanation tied to the actual documents before making a settlement decision.

Plan around verified information

Keep medical bills, wage records, repair documents and insurer correspondence organized. A policy limit, advertised verdict or online average is not money you can budget on receiving. If immediate expenses are difficult, compare assistance and payment arrangements using the amount actually due and written terms. SettlementLift cannot determine coverage or guarantee a recovery.
