Suboxone lawsuit: tooth decay claims over the sublingual film

Lawsuits allege that Suboxone film, a buprenorphine and naloxone medicine dissolved under the tongue, caused serious tooth decay and tooth loss, and that users were not warned. The federal cases are grouped in Ohio, and the first trial is not expected before 2028.

The FDA warning

In January 2022 the FDA warned that buprenorphine medicines dissolved in the mouth have been linked to tooth decay, cavities, oral infections and tooth loss, and required a new warning in the labeling. The FDA also said the benefits of these medicines clearly outweigh the risks.

The federal MDL

MDL 3092 is before Judge J. Philip Calabrese in the Northern District of Ohio. Defendants include Indivior and Aquestive Therapeutics. The federal panel reported 2,022 pending cases as of October 1, 2026.

Where the cases stand

In late 2024 the court allowed some failure-to-warn and design claims to continue and dismissed others. The bellwether schedule points to a first trial in 2028. No settlement has been announced.

Records that matter

Pharmacy records showing use of the film (not tablets or other forms), dates of use, dental records before and after treatment, and dental treatment costs such as extractions, crowns or implants.

Do not stop treatment on your own

Buprenorphine treats opioid use disorder. Talk to your prescriber before changing treatment, and follow the FDA’s oral-care steps, such as rinsing with water after the medicine dissolves and seeing a dentist regularly.

Deadlines

Each state sets its own filing deadline, and the clock often starts when you knew or should have known about the injury and its possible cause. Joining an MDL does not pause your state’s deadline, so ask a lawyer promptly if you are considering a claim.

Talking to a lawyer

Mass tort lawyers usually work on contingency, meaning they are paid a percentage of any recovery. Ask how the fee is calculated, which costs you could owe, whether your case would be filed in the MDL or in state court, and who will handle it day to day. SettlementLift is not a law firm and does not take or refer these cases.

Frequently asked questions

Can I still join the Suboxone lawsuit?

It depends on your state’s filing deadline and when you learned of the dental injury. A lawyer can review the dates in your records.

Does the lawsuit cover Suboxone tablets?

The federal MDL focuses on the sublingual film. Ask a lawyer how other forms are treated.
